Any agreements for paid advertising placements are subject to separate terms and conditions between Eventnites and the advertiser.

7b. Linking to Eventnites

  1. Our Services and Role

Eventnites is a comprehensive platform designed to support event organizers and attendees by streamlining event creation, management, and promotion. Our services enable organizers to plan and host in-person and virtual events, sell tickets, accept donations, book talent and venues, and engage with their audience using a variety of marketing tools.

Eventnites does not create, organize, or own the events listed on our platform, nor do we directly sell tickets, registrations, or merchandise for third-party events. Instead, we provide the technology and resources that allow organizers to manage event ticketing, registration, and marketing effectively.

When hosting an event, the organizer is fully responsible for:

  • Ensuring that their event and its listings adhere to all applicable laws, rules, and regulations.
  • Accurately describing and delivering the goods and services promoted on their event page.
  • Handling customer service matters, including disputes, refunds, and any liabilities associated with the event.

For events with paid ticketing, the organizer must choose a payment processing method. Attendees are required to use the designated payment method to complete their purchases.

If an organizer opts for Eventnites Payment Processing, we act as a limited agent to process payments through our third-party payment partners. If an external payment processor is selected, we transmit the payment details to the organizer’s chosen provider but do not process the transaction ourselves.

Eventnites allows all users to submit an offer to book talent for their events. When a user submits a booking request, the information is transferred to a third-party talent agency or representative, who will handle all communication, negotiation, and finalization of the booking directly between the user and the talent. Eventnites is not responsible for the outcome of these negotiations or any agreements made between the user and the talent representative.

The booked talent has no ownership, financial stake, or vested interest in the event beyond their agreed-upon appearance or performance. All obligations related to event promotion, ticket sales, and attendee experience remain the sole responsibility of the user or event Organizer.

Submitting a booking request does not guarantee talent availability, pricing, or confirmation of the booking. All bookings are subject to the talent representative’s terms and approval.

Eventnites is not responsible for cancellations, no-shows, or breaches of contract by talent. Any disputes regarding non-performance or cancellations must be resolved directly between the user and the talent representative.

The listing or availability of talent on Eventnites does not imply an endorsement, partnership, or affiliation with Eventnites. Talent engagements are independent transactions facilitated by third-party agencies.

Users are responsible for reviewing and adhering to any contracts, rider requirements, or additional terms set forth by the talent representative. Eventnites is not a party to these agreements.

Users agree to indemnify and hold Eventnites harmless from any claims, damages, or liabilities arising from talent bookings, including but not limited to, contract disputes, performance issues, or event-related incidents.

Payments, deposits, and financial terms related to talent bookings are determined by the talent representative and must be handled directly between the user and the talent representative. Eventnites does not process or hold funds for talent bookings.

  1. Independent Contractors

You agree and acknowledge that any relationship with Eventnites is that of an independent contractor. You are not an employee, partner, joint venture, or agent of Eventnites. Nothing in these Terms or in your use of the Eventnites platform shall be construed to create a relationship of employer and employee, partnership, or joint venture between you and Eventnites, its officers, directors, or employees.

As an independent contractor, you are responsible for your own taxes, including any federal, state, or local income, social security, or other taxes and contributions arising from your participation in any activities on the Eventnites platform. You shall have no authority to bind or obligate Eventnites in any manner, and you will not hold yourself out as an agent of Eventnites.

Eventnites may, at its discretion, provide or permit access to the platform’s tools, resources, and services. However, such access does not create an employer-employee or agency relationship. The independent contractor status shall remain in effect regardless of the nature of your relationship with Eventnites.

  1. Sub-Domains

Eventnites may provide sub-domains as part of its services, allowing users, including event organizers, venues, and other partners, to create branded event pages or customized experiences within the platform.

10a. Usage of Sub-Domains

All sub-domains created through the Eventnites platform remain the property of Eventnites LLC. Users are granted a limited, non-exclusive, and revocable right to use the sub-domain as part of the Eventnites services.

The user assigned to a sub-domain is solely responsible for ensuring that all content, event listings, images, and communications comply with applicable laws, Eventnites’ policies, and do not infringe upon third-party rights.

Users may be allowed to customize their sub-domain with branding, images, and descriptions. However, all customizations must align with Eventnites’ brand guidelines and terms of service.

10b. Restrictions on Sub-Domains

Sub-domains may not be used for unlawful, fraudulent, or misleading purposes.

Eventnites reserves the right to modify, suspend, or terminate any sub-domain that violates our policies or legal requirements.

Users may not attempt to sell, lease, or transfer a sub-domain to another party without prior approval from Eventnites.

10c. Termination & Revocation

Eventnites reserves the right to reclaim, suspend, or terminate any sub-domain at its sole discretion, including but not limited to cases of:

  • Violation of these Terms and Conditions.
  • Inactivity or abandonment of the sub-domain.
  • A legal request or compliance requirement.

By using an Eventnites sub-domain, users acknowledge and agree to these terms and understand that Eventnites maintains full authority over all sub-domains created on its platform.

  1. Termination

Eventnites reserves the right to suspend, restrict, or terminate your access to the Platform and Services at any time, with or without cause, and with or without prior notice, under the following circumstances:

  • If you breach these Terms, any applicable policies, or engage in fraudulent, illegal, or abusive behavior.

  • If you fail to pay any applicable fees, charges, or outstanding balances owed to Eventnites.
  • If you misuse the Platform, including but not limited to spamming, unauthorized use of Eventnites branding, or misrepresenting event details.
  • If you infringe upon the intellectual property rights of Eventnites, other users, or third parties.

11a. Termination by the User

You may terminate your account at any time by submitting a request through your account settings or by contacting Eventnites customer support. Termination of your account does not relieve you of any outstanding financial obligations, including pending transactions, event-related responsibilities, or payments due to Eventnites or third parties.

11b. Upon Termination of your Account

You will lose access to your account, including any active events, ticket sales, or bookings.

Any payments, fees, or deposits made prior to termination are non-refundable unless otherwise required by applicable law.

If you are an Organizer, you are still responsible for fulfilling obligations related to previously sold tickets, event execution, and any consumer or vendor agreements.

Eventnites may retain certain information in compliance with legal, regulatory, or operational requirements, including financial records, transaction history, or dispute resolution data.

11c. Survival of Terms

Certain provisions of these Terms, including but not limited to, indemnification, limitation of liability, dispute resolution, and any outstanding payment obligations, will survive termination.
